TRIAL and purchase POLICies

We pride ourselves in providing a hassle-free trial and purchase policy with all terms and conditions disclosed with every saddle! If you would like to trial a saddle, you can put it in your cart to pre-pay, and we will send you a trial contract to be signed via DocuSign as soon as possible! Following the signatures collected from the contract, we will ship the saddle via FedEx Ground to your residence Monday through Friday. Weekend shipments take place only for expedited shipments such as 2-day, next-day, and overnight. We will ship to Canada for trials, but different rates apply. 

Flat rate shipping $80.00 each way in the US applies to most US states.

Flat rate shipping of $100.00 each way to California, Florida, Texas, Arizona, Colorado, Washington, Oregon, Louisiana, Alabama, Missouri, New Mexico. 

Dressage saddles are flat rate $120.00 each way to any of the 48 states in the US due to their flap size.

*Additional discounted shipping speeds are available via Fedex . Please ask us about a shipping service upgrade and we will provide a quote. 

*Shipping rates to HI, Alaska, and Canada are a discounted quote, usually no more than $120 USD.

International shipments will have multiple carrier quotes for optimal cost savings.

TERMS AND CONDITIONS FOR TRIALS: 

· “The trial period” allows 120 hours (exactly 5 days) for non-in-person fittings, or 3 days for in person fittings, only via a signed trial contract as a courtesy for "the buyer" to have time to inspect and ride in "the saddle". If "the saddle" does not suit the rider or horse, it will be eligible for a refund less shipping charges or a fitting fee if all terms and conditions in the signed contract are met and followed.

· “The buyer(s)” is/are the person/people who authorized the payment to “the seller”, Ashley’s Fine English Tack. 

· “The purchased saddle” is the item  purchased by "the buyer" in "as is" condition.

· “As is” condition is the condition of “The saddle” after it is purchased and received. There isn't any recourse or refunds should the buyer discover a defect in the product after the purchase, unless they signed a trial contract, and they are within the terms. Saddles are sold without warranty unless disclosed in the listing.

· A “Final sale”  follows the purchase of a saddle from Ashley’s Fine  Tack with "the buyer" either by accepting official ownership during the "trial period", breach of signed trial contract, failing to complete a trial contract, or purchasing a used saddle without a trial. No returns, refunds or negotiations for a refund are considered once a sale has been deemed final by Ashley's Fine English Tack.
 

1. ****The terms in this policy are binding to all customers and are non-negotiable unless discussed in advance, with new terms agreed upon in writing. If trialing a saddle, your refund may be subject to late fees, or refusal if shipping instructions and timelines in the trial contract are not read and followed. 

2.**** A decision must be reached to keep or return “The saddle” within five allowed trial days. “The buyer" has 24 hours to ship the saddle. If the saddle is not shipped within 24 hours of the decision, the sale will be finalized. *******

3. “The saddle” must  arrive via only FedEx to Ashley’s Fine English Tack within 7 calendar days after the 24 hour grace period to ship the saddle. Our shipping methods are organized to work with this if "the saddle" is shipped in a timely manner. 

4. You may pay for additional, expedited shipping if there is a concern "the saddle" will arrive late. This will only be offered via FedEx in the US. 

5. **** If "the saddle" arrives later than 7 days due to delays by "the buyer" without a reasonable explanation, the saddle will be deemed a final sale, without refund offered. The buyer will own the saddle, and it will be shipped back at their expense. NO EXCEPTIONS.***

5. ****Neglecting the shipping instructions below will result in a “final sale”, or damage deductions, if there is damage. ****

6.****All funding must clear,  from  the "the buyer" prior to  “The trial period”. Failure to produce immediate funding will result in the saddle being picked up, or legal recourse for the cost of the saddle plus any legal fees incurred.

Returns, Fees and Shipping Instructions for trialed saddles: 

1. Shipping fees for shipped saddles will be withheld from the initial payment. Shipping  will be charged according to it's flat rate, and is not refundable if "the saddle" is returned.

2. “The buyer” is subject to paying an in person fitting fee when one or multiple saddles are brought to be tried in person. Fitting fees up to a 1-hour radius are $80.00 and $200 for up to a 4-hour radius. The fitting fee will only be waived if “The Buyer” concludes their trial with a “Final sale”. 

3. A FedEx label or barcode will be provided to you to return "The saddle" and the flat rate shipping charges will be withheld from your refund.  “The saddle” will be insured and shipped FedEx Ground at a special discounted rate back to Ashley's Fine English Tack. 

4. The buyer will pack "the saddle" utilizing the original 24x 18 x 18 double wall, corrugated,  275 lb crush-tested box. “The saddle’s” entire tree must be fully bubble-wrapped with several layers and packed with the original packing materials. The original saddle cover sent with “The saddle” and must fully cover it during shipping. Place the saddle “flaps up” in the bottom of the box. Place extra packing material under the seat and tree to support it.

5. In our experience, FedEx consistently "Wows" us in service, and outperforms all parcel carriers country-wide, which is why we choose them over others to handle our precious saddles. Shipping via other carriers may possibly result in a final sale if late, lost or damaged.

Damage Deductions and Conditions:

1. The saddle must arrive in the same condition as it left Ashley's Fine English Tack, or deductions will apply. Any damages incurred to “the saddle” will result in deductions outlined below, or a “final sale” in the “as is”, damaged condition. 

2.  Damage that occurs during “the trial period” or is caused by the shipping company upon return of “the saddle” includes but is not limited to: water damage, animal damage, permanent scratches, divots, or gouges to the leather that decrease the value; will have a damage deduction from the total refund starting at $200.00 up to $650.00 USD based on an invoice to repair, if the repair is salvageable. All saddles have verifiable pre-shipping video & are compared to verify damage. It is imperative that “the saddle” is insured for its full purchase price to protect you, the shipper, and is packed as instructed to help avoid shipping damage liability.

3.  If “The saddle” succumbs to severe damage, theft, or water damage while located at the trial home, or if “The saddle” is not insured and is damaged or lost during shipping, “The buyer” is not eligible for a refund. Physical damage to “The saddle” includes but is not limited to: damage to the tree, leather, or other major leather components that will affect the overall integrity of the saddle. 

4. An overuse fee of $100 will be deducted from “The saddle’s” refund for any excessive wear such as water droplet stains, stirrup leather wear, or saddle returns excessively dirty. A separate pre-paid invoice will be provided

5. If the original saddle cover is lost, stolen or damaged, the retail cost of a new, brand-name cover for “The saddle” will be withheld, and an invoice will be provided to you.

****By purchasing a saddle from Ashley's Fine English Tack,  “The buyer” agrees to all the terms set forth in this trial and purchase policy. “The buyer” also by default agrees on the saddle’s current condition based on provided photos, serial number, and description prior to shipping. “The buyer” assumes full liability for loss and damage of “the saddle” during “The trial period while it is their complete custody and control”.

****“The buyer” will utilize a valid form of payment that is in their direct custody and control, to authorize Ashley’s Fine English Tack to charge. All parties with permission to purchase on behalf of "the buyer" must sign the contract in conjunction with the buyer. No chargebacks will be granted.
 

*****Failure to follow any portion of these terms and conditions with or without a signed trial contract on file, will result in a direct breach of contract and could result in a forfeiture of refund .
